DLP Marketing ("we," "us," or "our") is a registered DBA (Doing Business As) of DLP Business Support Services LLC, a Texas limited liability company. These Terms of Service ("Terms") govern your access to and use of our website and our marketing, CRM, website, automation, and related business services (collectively, the "Services").

1. Eligibility
You must be at least 18 years old and able to form a binding contract to use our Services. By using the Services, you represent that you meet these requirements and that any business information you provide is accurate and that you are authorized to provide it.
2. Our Services
We provide marketing, branding, and business-support services to businesses, including but not limited to website and funnel development, GoHighLevel (GHL) CRM setup and automation, A2P 10DLC / SMS compliance assistance, lead-generation support, and related consulting. Specific deliverables, timelines, and fees are defined in a separate proposal, statement of work, or written agreement between you and us. In the event of a conflict, that separate agreement controls over these Terms with respect to its subject matter.
3. Client Responsibilities
- Provide accurate, complete, and lawful information and materials needed for us to perform the Services.
- Ensure you hold all rights and licenses to any content, brand assets, or data you provide to us.
- Maintain your own compliance with laws and platform/carrier rules applicable to your business, including obtaining valid consumer consent for your own marketing and messaging.
- Review and approve deliverables and provide timely feedback.
You are solely responsible for your own regulatory compliance (including insurance licensing, TCPA, CMS, and carrier requirements applicable to your business). We provide tools, builds, and guidance, but do not act as your legal, compliance, or licensing authority.
4. Fees & Payment
Fees, payment schedules, and refund terms are set out in your applicable proposal or agreement. Unless otherwise stated, fees are due as invoiced and are non-refundable once work has commenced. Late payments may result in suspension of Services.
5. Intellectual Property
Unless otherwise agreed in writing, we retain ownership of our pre-existing materials, templates, tools, and know-how. Upon full payment, you receive a license to use the final deliverables produced for you for your business purposes. You retain ownership of the content and brand assets you provide to us.
6. SMS / Text Messaging Terms & Consent
These messaging terms apply to text messages sent by DLP Marketing to you.
Consent
By providing your mobile number and checking a consent box on our website, booking an appointment, or otherwise opting in, you consent to receive text messages from DLP Marketing (a DBA of DLP Business Support Services LLC). Consent is optional and is not a condition of purchasing any product or receiving any service. Messages may be sent using an automated system, CRM, or automatic telephone dialing system (ATDS) and may include prerecorded or artificial voice messages.
Message types & frequency
Messages may include transactional/service messages (such as appointment confirmations, reminders, and project updates) and, where you have opted in, marketing messages. Message frequency varies. Message and data rates may apply.
Opt-out & help
Reply STOP to any message to opt out at any time. Reply HELP for assistance, or contact us using the information below. This consent applies even if your number is listed on a state or federal Do Not Call registry.
Carrier liability
Wireless and mobile carriers are not liable for delayed or undelivered messages. Delivery of text messages is subject to effective transmission by your wireless carrier and is not guaranteed by DLP Marketing.
Mobile information and consent records (including phone numbers and SMS opt-in data) will not be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors and service providers in support of our Services (such as CRM, calendar, messaging, or compliance providers) is permitted only for the purpose of delivering those Services to you. 7. Acceptable Use
You agree not to use our website or Services to violate any law, infringe others' rights, transmit malicious code, attempt unauthorized access, or send unlawful or unsolicited communications. We may suspend or terminate access for conduct we reasonably believe violates these Terms.
8. Third-Party Services
Our Services may rely on or integrate third-party platforms (such as GoHighLevel, Twilio, Meta, and others). Your use of those platforms is subject to their own terms and policies. We are not responsible for third-party services, their availability, or changes to their features or rules.
9. Disclaimers
The Services and website are provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not guarantee specific results, lead volumes, revenue, approval outcomes (including A2P/carrier approval), rankings, or business performance. Results depend on many factors outside our control.
10. Limitation of Liability
To the fullest extent permitted by law, DLP Business Support Services LLC and its owners, members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or lost profits or revenues, arising out of or related to your use of the website or Services. Our total aggregate liability for any claim will not exceed the amounts you paid to us for the Services giving rise to the claim in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless DLP Business Support Services LLC and its personnel from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Services, your own communications and marketing, or your violation of these Terms or applicable law.
12. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts located in Texas, and you consent to their jurisdiction.

We may update these Terms from time to time. The "Last updated" date above reflects the most recent version. Continued use of our website or Services after changes take effect constitutes acceptance of the updated Terms.
